Fair Debt Collections Practices Act (FDCPA)
As we fight and litigate against financial institutions (including the banks), we found the best strategy to accomplish the desired outcome is to cost the banks as much money as possible. Many of our clients are seeking a reduction in principle, a settlement of their credit cards, or a victory in the courtroom. It is our job to assist the client in reaching their goals or at the very least to devise the best strategy to accomplish these goals.
In our humble opinion, banks and other financial institutions do not speak any language. They do not speak English, Spanish, French, or Greek; instead, they speak the language of currency. The banks understand money, currency, and increased cost. To understand this is to understand their thinking process and to more easily accomplish the goal of seeking an equitable resolution.
The other side of the issue is each person has certain rights that need to be protected to keep negotiations balanced. The banks have nearly unlimited money and in many cases they use these resources to harass debtors in the hope that you will pay them to go away. Many people fall victim to this strategy.
As a law firm, we attempt to protect your rights and even the playing field. Once we represent you, it becomes illegal for the bank and/or financial institution to contact you. They cannot reach you by telephone, email, mail, or visit you at your house. If they do any of these actions, we will start the process of a FDCPA (Fair Debt Collections Practices Act) violation. They statutory amount of damages is up to $1,000 and they have to pay your attorney fees.
Summary: Once this law firm represents you, the bank cannot contact you. If they do, we will start a proceeding for the violation of FDCPA (Fair Debt Collection Practices Act). The statutory amount is $1,000 and the payment of your attorney fees. This is used as a means to cost the bank money and to protect your rights.
Remember, at Myers & Eichelberger, we are focused on aggressively representing you and not just buying you time. You have rights and you deserve to have them protected.
